1. Acceptance of Terms
By accessing or using the TukoKadi website (tukokadi.org) and related services (collectively, the "Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Platform.
By using the Platform, you represent that you are at least 18 years of age or the age of majority in your jurisdiction. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. What TukoKadi Does
TukoKadi is a civic technology platform that tracks political leaders' campaign promises and actual delivery. We issue "Red Card" verdicts based on publicly available evidence and verified citizen reports.
Important: The Red Card is a civic pledge tool, NOT an official electoral sanction. Voting remains secret and constitutionally protected. TukoKadi does not replace or override any electoral laws or processes.
Our platform enables users to:
- View leader performance scorecards and verdicts
- Take the Red Card Pledge
- Submit reports of broken promises
- Create and save personal Red Card ballots
- Participate in constituency-based discussions
- Apply to become a TukoKadi ambassador
3. User Conduct
You agree NOT to engage in any of the following prohibited activities:
Submit false or malicious broken promise reports
Use the platform to harass, threaten, or defame any individual
Incite violence or hate speech against any leader or group
Attempt to hack, scrape, or disrupt the website
Impersonate another person or entity
Post spam, phishing attempts, or malicious links
Use automated scripts to access our platform
Violations may result in a permanent ban from the platform and referral to relevant authorities.
4. User-Generated Content
You retain ownership of the content you submit to the Platform, including reports, pledges, comments, and messages. By submitting content, you grant TukoKadi a non-exclusive, royalty-free, worldwide license to display, store, verify, and publish that content (anonymously) on our platform.
You represent and warrant that:
- You own or have permission to share the content you submit
- Your content does not violate any third-party rights
- Your content is accurate and truthful to the best of your knowledge
- Your content complies with these Terms of Use
We reserve the right to remove any content that violates these terms or is proven false, without prior notice.
5. Accuracy of Information
We strive for accuracy in our leader tracking and promise verification. However, we do not guarantee that all leader data, promise tracking, or verdicts are 100% complete or error-free.
Our process:
- Evidence is sourced from public records, official documents, and citizen reports
- Each report undergoes verification by our research team
- Leaders may appeal verdicts by submitting counter-evidence to review@tukocadi.co.ke
- We update information as new evidence becomes available

6. Intellectual Property
The TukoKadi name, logo, design, code, and original content are our intellectual property and are protected by copyright, trademark, and other laws.
You may not:
- Copy, reproduce, or resell our platform without written permission
- Use our name or logo in a way that suggests endorsement
- Modify or create derivative works based on our platform
- Remove any copyright or proprietary notices
However, you may:
- Share and embed watchlist data for non-commercial, civic purposes
- Link to our website from your blog or social media
- Quote our content with proper attribution

7. Third-Party Links
Our platform may contain links to external websites, including government documents, news articles, and social media. We do not control or endorse these third-party sites and are not responsible for their content, privacy practices, or terms of use.
You access third-party links at your own risk. We recommend reviewing their terms and privacy policies before using them.
8. Disclaimer of Warranties
TUKOKADI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Non-infringement of third-party rights
- Uninterrupted or error-free access to the platform
- Accuracy, reliability, or completeness of any information
- That the platform will be free from viruses or harmful code
You use the platform at your own risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUKOKADI AND ITS VOLUNTEERS, CONTRIBUTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Personal injury or property damage
- Damages arising from your use of or inability to use the platform
- Damages arising from reliance on leader verdicts or citizen reports
Our total liability shall not exceed the amount you paid us (if any) to use the platform.
10. Termination
We may suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that violates these Terms of Use or is harmful to other users or the Platform. Reasons for termination include but are not limited to:
- Violation of user conduct rules
- Submission of false or malicious reports
- Harassment of other users or leaders
- Attempts to manipulate leader verdicts
You may stop using the Platform at any time. Upon termination, your right to use the Platform ceases immediately.
11. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.
Any disputes arising from these terms or your use of the Platform shall be resolved exclusively in the courts of Nairobi, Kenya. You consent to the personal jurisdiction of these courts.
12. Changes to Terms
We may update these Terms of Use from time to time. Changes will be posted on this page with an updated "Effective Date."
If we make material changes, we will notify you by:
- Posting a notice on our website
- Sending an email to registered users (if applicable)
Continued use of the Platform after changes constitutes acceptance of the revised terms.
